GENERAL CONDITIONS
1. SCOPE AND SUBJECT OF THE GENERAL TERMS AND CONDITIONS
These General Terms and Conditions (hereinafter also referred to as the "Terms") apply to all activities of the service provider/event organizer, Dominika Schütze, such as yoga classes, massages, workshops, yoga holidays/retreats, etc., and/or any unspecified contractual agreements related to the mentioned business activities.

The service provider primarily offers paid services in the field of yoga and massage. These Terms are applicable to the provision of any services to participants obtained in any manner (by phone, email, website, mobile, etc.) from the service provider. A participant is any natural or legal person who avails services provided by the service provider or has registered for such services. By using one or more services, the participant irrevocably agrees to abide by these Terms.

2. GENERAL
2.1 The following general terms and conditions apply to the conduct of all yoga courses, private lessons, events, massages, and other activities. By making a binding registration, these terms and conditions are deemed legally binding and accepted by the course participant.
2.2 Changes to these general terms and conditions are generally excluded and will only be effective in case of deviating special agreements if they are made in writing.

3. SCOPE OF SERVICES
The services include the conduct and organization of yoga classes, massages, coaching, and workshops.

4. COSTS, PRICES, AND PAYMENT TERMS
4.1 The current costs for all offers are visible on the website and can be communicated in writing upon request.
4.2 Registrations for all offers (except subscriptions, see Pt. 4.3) are legally binding with their payments made by email, online reservation, or SMS. For telephone registrations, they will be confirmed by email, and upon receipt of the confirmation email by the participant, these registrations become legally binding and can be invoiced. Failure to pay for the course does not constitute a cancellation.
4.3 The full payment for yoga classes/subscriptions is due before the start of the lessons. Unless otherwise agreed or indicated, payment is made on the first day of the course at the studio or online on the website.
5. PURCHASE OF VOUCHERS
5.1 Vouchers can be purchased from the service provider and serve as payment for yoga classes, massages, or other services, where applicable.
5.2 The voucher amount is to be paid in full in advance and can be paid either on-site at the studio or online on the website.
5.3 Vouchers are non-transferable and have a validity period of 12 months from the date of purchase, unless otherwise specified.
5.4 Vouchers cannot be redeemed for cash and are non-refundable. They also cannot be used to purchase other vouchers.
5.5 In case of loss or theft of a voucher, Dominika Schütze assumes no liability. Vouchers are considered bearer instruments, and the holder is responsible for their safekeeping.
5.6 The use of vouchers is subject to the same conditions as the participation in regular offers, as specified in these General Terms and Conditions.
5.7 The use of vouchers is only permitted for those services that are available at the time of voucher purchase on the website or in printed form.
5.8 In the event of bankruptcy or closure of the company, the voucher holder has no claim to refund or replacement unless required by law.
5.9 The voucher holder is responsible for complying with the specified validity period of the voucher and redeeming the voucher before its expiration date. After the validity period expires, the voucher becomes invalid and cannot be used.

6. TERMS AND CANCELLATION POLICY (REFUNDS)
6.1 Yoga Classes Yoga subscriptions expire after their validity date, are personal, and not transferable. Yoga subscriptions are valid from the date of purchase. Paid course fees will not be refunded. Monthly subscriptions can be paused for holidays or absences due to professional reasons lasting longer than two weeks, for the duration stated in advance in writing. Retroactive pauses are not possible. In the case of illness, accident, or pregnancy, the duration of all subscriptions can be paused upon presentation of a medical certificate if no services have been availed during the certified period.
Changes to the schedule or teaching personnel can be made at any time. There is no entitlement to a refund.
Classes can also be attended without prior registration. In this case, we recommend being at the studio at least 10 minutes before the start of the class. We cannot guarantee available spots.
6.2 Workshops and Events In case of inability to attend workshops or other events, the participant has the option to find a substitute person. This should be communicated in writing via email, providing the name, first name, and email address of the substitute person.
Unattended sessions cannot be made up for and will not be refunded, unless agreed otherwise in writing. In case of absence (illness, professional commitments, other reasons) or early termination of the workshop/event, there is no entitlement to a reduction or refund.
6.3 1:1 Lessons, Coaching, Massages Cancellations for private lessons, coaching, and massages are accepted only if the relevant information is received by phone or email at least 24 hours before the start of the course.
6.4 The course instructor reserves the right to cancel yoga classes - including at short notice - or to be represented by a suitably qualified person in case of illness or unforeseeable emergency. Participants will be informed of cancellations via email or phone as quickly as possible, except in the case of unforeseeable cancellations. In the event of course cancellation, the subscriptions can be extended accordingly.
6.5 To conduct our courses under optimal conditions, we set a minimum and maximum number of participants depending on the event/course. If the minimum number of participants is not reached, the course will generally not be conducted, and the course fees will be refunded.

7.ELIGIBILITY, SELF-RESPONSIBILITY
7.1 Before participating in Dominika Schütze's yoga classes, an online registration or registration form must be completed. By accepting these Terms, the participant confirms that there are no health concerns for participating in yoga classes. All courses, yoga classes, private lessons, events, massages, and workshops require self-responsibility and normal mental and physical resilience and condition. In case of acute physical or mental problems, it should be clarified with a doctor beforehand whether yoga classes and/or massages are advisable at that time. Yoga classes can have a healing effect on physical, mental, and psychological well-being, but they do not constitute medical or psychotherapeutic treatments.
7.2 Existing psychological or physical health restrictions, as well as an existing pregnancy, must be reported to the course instructor at the latest at the beginning of the course/massage/event. If a health restriction or pregnancy occurs during the course/massage/event, the course instructor must be informed immediately.
Each participant participates in these courses at their own risk, so it is also at the discretion of each participant to seek medical advice before participating in the courses.

8. LIABILITY
8.1 Dominika Schütze assumes liability for the proper conduct of the courses/events/massages/workshops within the framework of statutory warranty provisions. Any further liability, especially under the title of damages, is expressly excluded. The organizers, therefore, assume no liability of any kind, particularly no liability in the event of concealing any physical or mental ailments that may make participation in yoga events/workshops inadvisable.
Dominika Schütze reserves the right to reject participants if she believes that the health or psychological conditions for participating in the course are not given. This rejection can also be made at short notice or even during ongoing courses. In case of participant rejection, the costs (proportionally) will be refunded to the participant.
8.2 The use of the premises and services is at the participants' own risk. No liability is assumed for valuables brought by the participants.
8.3 For all yoga courses and workshops organized by Dominika Schütze, we exclude any liability for damages incurred. Therefore, you are responsible for adequate insurance coverage. Dominika Schütze cannot be held liable for theft and loss of objects.

9. PLACE OF PERFORMANCE, JURISDICTION, AND APPLICABLE LAW
9.1 The place of performance for all obligations is agreed to be the registered office of the service provider, which is 1245 Collonge-Bellerive.
9.2 Swiss law applies; for any disputes, a conciliation body in Geneva will be consulted in the first instance. Further disagreements that cannot be resolved with the conciliation body will subsequently be subject to the exclusive jurisdiction of the respective court in Geneva within the scope of its respective subject matter jurisdiction.
9.3 Should individual provisions of these general terms and conditions, as well as any individually concluded contracts, be null and void, ineffective, or contestable, the remaining (part) provisions shall remain unaffected and shall then be interpreted or supplemented in such a way that the intended economic purpose is achieved as precisely as possible in legal terms.
9.4 Oral side agreements will not be made. Changes and additions to these Terms and all membership agreements require written form.

10. DATA PROTECTION
The course instructor undertakes to treat personal data and information confidentially and not to disclose them to third parties. This includes the disclosure of data to employees and business partners for organizational purposes. Likewise, the participant undertakes to treat information about other course participants confidentially.

11. MISCELLANEOUS
Dominika Schütze uses photos/videos of courses and events on her own website or social media, on which participants may be recognizable. If this is done against the will of a person, he/she can request Dominika to remove his/her image from the picture. No further or individual claims can be asserted.
